By accessing, purchasing, downloading, installing, customizing, or using the Lemony Website Template, you agree to these Terms of Use and the applicable License terms.
The Lemony Website Template is a website template product created by Rapid Response IT. It may include HTML files, CSS, JavaScript, page layouts, graphics, demo content, documentation, and related materials.
Demo content, placeholder business names, sample phone numbers, sample pricing, sample reviews, and sample images are provided for demonstration purposes only and must be replaced before public launch.
You must purchase a valid license from Rapid Response IT or an authorized Rapid Response IT sales channel before using the Template for any business, commercial, client, public, or production purpose.
Use of an unauthorized, copied, pirated, leaked, shared, or redistributed version of the Template is prohibited.
After valid purchase, you may use the Template for your own business website or for one approved client website, unless Rapid Response IT provides written permission for additional use.
You may customize the Template to fit the licensed business, including changes to content, images, branding, colors, sections, links, order, event, and contact tools, and service descriptions.
You may not resell, redistribute, sublicense, share, publish, transfer, upload, give away, or commercially exploit the Template as a template, theme, design kit, downloadable product, marketplace listing, or competing website product.
You may not provide the source files to another party for reuse outside the licensed website.
If your website is hosted, managed, maintained, or provided as an active service by Rapid Response IT, the Powered by Rapid Response IT attribution must remain visible and unaltered unless Rapid Response IT provides written permission.
Removing, hiding, disabling, obscuring, or modifying this attribution while receiving Rapid Response IT hosting or managed website menu items is a violation of these Terms.
Rapid Response IT may suspend or terminate hosting, managed menu items, support, access to updates, or related menu items if these Terms are violated, if payment is not made, or if the Template is used unlawfully or without authorization.
You may not use the Template or Rapid Response IT menu items for unlawful, fraudulent, deceptive, abusive, harmful, infringing, or prohibited activities. Rapid Response IT reserves the right to refuse, suspend, or terminate service for misuse.
The Template may be connected to third-party tools such as scheduling platforms, payment processors, analytics tools, maps, forms, CRMs, or marketing menu items. Rapid Response IT is not responsible for the operation, pricing, security, availability, or policies of third-party menu items.
Rapid Response IT reserves the right to pursue all remedies available under applicable law and contract, including suspension or termination of menu items, revocation of license rights, injunctive relief, damages, and recovery of reasonable attorney's fees and court costs where permitted by law.
Rapid Response IT does not guarantee that use of the Template will result in increased traffic, guests, sales, menu, event, and orderings, search rankings, or revenue. Website performance depends on many factors, including business reputation, content quality, pricing, photos, service area, advertising, and follow-up.
The Template and related materials are provided as-is and as-available. Rapid Response IT disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation to the fullest extent permitted by law.
To the fullest extent permitted by law, Rapid Response IT shall not be liable for indirect, incidental, consequential, special, punitive, or lost-profit damages related to the Template, hosting, support, customization, or related menu items.
These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action related to these Terms shall be brought in a court of competent jurisdiction in Florida unless otherwise required by law.
Rapid Response IT may update these Terms from time to time. Continued use of the Template or related menu items after updates are posted constitutes acceptance of the updated Terms.
